State of Madhya Pradesh<\/em> and <em data-start=\"327\" data-end=\"363\">Simarnjit Singh v. State of Punjab<\/em> underscore a foundational principle of our criminal jurisprudence \u2014 <strong data-start=\"432\" data-end=\"506\">no matter how stringent the law, procedural fairness is non-negotiable<\/strong>.<\/p>\n<p data-start=\"509\" data-end=\"913\">Both appellants were initially convicted under the <strong data-start=\"560\" data-end=\"627\">Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act)<\/strong>, a special legislation designed to combat drug-related offences with a heavy hand. The Act is known for its <strong data-start=\"736\" data-end=\"820\">harsh sentencing provisions, reverse burden of proof, and limited scope for bail<\/strong> \u2014 making it essential that every procedural safeguard be followed with unwavering precision.<\/p>\n<p data-start=\"915\" data-end=\"1281\">In <em data-start=\"918\" data-end=\"930\">Mangilal\u2019s<\/em> case, the prosecution faltered due to <strong data-start=\"969\" data-end=\"1135\">hostile witnesses, non-compliance with Section 52A (regarding the disposal of seized contraband), and key police testimony revealing pre-existing seized materials<\/strong> \u2014 all of which went unchallenged by the prosecution. The higher court rightly refused to overlook these glaring lapses and acquitted the accused.<\/p>\n<p data-start=\"1283\" data-end=\"1611\">Similarly, in <em data-start=\"1297\" data-end=\"1316\">Simarnjit Singh\u2019s<\/em> matter, the Court relied on the precedent in <em data-start=\"1362\" data-end=\"1397\">Union of India v. Mohanlal &amp; Anr.<\/em> to hold that <strong data-start=\"1411\" data-end=\"1488\">sampling of seized narcotics must be done in the presence of a Magistrate<\/strong>. Since this wasn\u2019t followed, the authenticity of the evidence was questionable, leading to the reversal of the conviction.<\/p>\n<hr data-start=\"1613\" data-end=\"1616\" \/>\n<h3 data-start=\"1618\" data-end=\"1636\"><strong data-start=\"1622\" data-end=\"1636\">My Opinion<\/strong><\/h3>\n<p data-start=\"1638\" data-end=\"1940\">I strongly believe that both these decisions are <strong data-start=\"1687\" data-end=\"1787\">not only legally sound but also vital to preserving the integrity of our criminal justice system<\/strong>. The courts have rightly reminded all stakeholders \u2014 especially investigating agencies \u2014 that <strong data-start=\"1882\" data-end=\"1939\">stringent laws cannot override procedural due process<\/strong>.<\/p>\n<p data-start=\"1942\" data-end=\"2251\">These judgments reaffirm the age-old maxim: <em data-start=\"1986\" data-end=\"2061\">&#8220;Let a hundred guilty go unpunished, but one innocent should not suffer.&#8221;<\/em> In the context of special legislations like the NDPS Act, where <strong data-start=\"2126\" data-end=\"2201\">accused persons face severe consequences right from the point of arrest<\/strong>, judicial oversight becomes all the more crucial.<\/p>\n<p data-start=\"2253\" data-end=\"2287\">Such decisions are much needed to:<\/p>\n<ul data-start=\"2288\" data-end=\"2458\">\n<li data-start=\"2288\" data-end=\"2338\">\n<p data-start=\"2290\" data-end=\"2338\"><strong data-start=\"2290\" data-end=\"2317\">Prevent misuse or abuse<\/strong> of special statutes,<\/p>\n<\/li>\n<li data-start=\"2339\" data-end=\"2401\">\n<p data-start=\"2341\" data-end=\"2401\">Ensure <strong data-start=\"2348\" data-end=\"2396\">evidence is collected and preserved lawfully<\/strong>, and<\/p>\n<\/li>\n<li data-start=\"2402\" data-end=\"2458\">\n<p data-start=\"2404\" data-end=\"2458\">Uphold the <strong data-start=\"2415\" data-end=\"2457\">constitutional mandate of a fair trial<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2460\" data-end=\"2620\">In essence, the judiciary has acted as the true sentinel on the qui vive \u2014 reminding us that the rule of law must prevail, even in the face of serious offences.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>By Advocate Tarun Gaur, Practicing in Delhi High Court In a welcome development, the judgments in Mangilal v.
