A. 585\/2020]"},"content":{"rendered":"<p data-start=\"195\" data-end=\"629\">The Delhi High Court has recently passed a pragmatic and legally sound judgment in allowing a petitioner\u2014convicted by a Trial Court under the Prevention of Corruption Act and IPC provisions\u2014to travel abroad to meet his daughter. While the prosecution insisted that the petitioner\u2019s conviction under serious offences warranted a travel restriction, the Hon\u2019ble Court took a more constitutionally grounded and rights-conscious approach.<\/p>\n<h3 data-start=\"631\" data-end=\"665\">Understanding the Legal Nuance<\/h3>\n<p data-start=\"667\" data-end=\"1147\">The Court noted a crucial distinction: the petitioner\u2019s appeal against conviction had already been admitted, and more importantly, his sentence had been <strong data-start=\"820\" data-end=\"833\">suspended<\/strong>. This is not just a procedural technicality\u2014it goes to the heart of our criminal justice system and constitutional principles. Once a sentence is suspended, the individual cannot be deemed a &#8220;convict&#8221; for all practical purposes, especially when the appeal is pending and the conviction is under judicial scrutiny.<\/p>\n<p data-start=\"1149\" data-end=\"1452\">To curtail someone\u2019s right to travel abroad\u2014especially to meet immediate family\u2014on the sole ground of a <strong data-start=\"1253\" data-end=\"1277\">non-final conviction<\/strong> would set a dangerous precedent. It would mean punishing an individual beyond what the law prescribes, while ignoring the presumption of innocence during the appellate stage.<\/p>\n<h3 data-start=\"1454\" data-end=\"1503\">Liberty Cannot Be Sacrificed on Hypotheticals<\/h3>\n<p data-start=\"1505\" data-end=\"1839\">There was no concrete apprehension presented by the prosecution that the petitioner was a flight risk or that he intended to evade justice. Mere allegations of past misconduct\u2014already tried in court and currently under appeal\u2014cannot override the fundamental right to life and personal liberty under <strong data-start=\"1804\" data-end=\"1838\">Article 21 of the Constitution<\/strong>.<\/p>\n<p data-start=\"1841\" data-end=\"2083\">Moreover, courts across India have consistently held that unless there are compelling reasons such as tampering with evidence, absconding, or threat to society, bail conditions should not become a tool to impose disproportionate restrictions.<\/p>\n<h3 data-start=\"2085\" data-end=\"2115\">A Humanitarian Perspective<\/h3>\n<p data-start=\"2117\" data-end=\"2382\">The petitioner sought to travel abroad to meet his daughter\u2014an act rooted in basic human emotion and not malice. The judiciary\u2019s role is not just to punish, but to ensure <strong data-start=\"2288\" data-end=\"2311\">procedural fairness<\/strong> and to protect the <strong data-start=\"2331\" data-end=\"2360\">dignity of the individual<\/strong>, even when convicted.<\/p>\n<p data-start=\"2384\" data-end=\"2543\">In this light, the High Court\u2019s decision reaffirms the principle that justice must not only be done but must also be seen to be just, balanced, and empathetic.<\/p>\n<h3 data-start=\"2545\" data-end=\"2559\">Conclusion<\/h3>\n<p data-start=\"2561\" data-end=\"3028\">The judgment is not about leniency toward white-collar crimes. It is about recognizing that <strong data-start=\"2653\" data-end=\"2728\">until all remedies are exhausted, no conviction can be treated as final<\/strong>. By allowing the petitioner to travel abroad in the face of a suspended sentence, the Hon\u2019ble Court has rightly upheld the values of <strong data-start=\"2862\" data-end=\"2918\">due process, proportionality, and individual liberty<\/strong>.
