{"id":1536,"date":"2026-09-02T12:26:44","date_gmt":"2026-09-02T06:56:44","guid":{"rendered":"https:\/\/tarungaur.in\/mediacenter\/?p=1536"},"modified":"2026-09-02T13:19:57","modified_gmt":"2026-09-02T07:49:57","slug":"criminal-revision-under-indian-law","status":"publish","type":"post","link":"https:\/\/tarungaur.in\/mediacenter\/criminal-revision-under-indian-law\/","title":{"rendered":"Criminal Revision under Indian Law"},"content":{"rendered":"<p><strong>Revision<\/strong> is the High Court\u2019s and the Sessions Judge\u2019s power to examine a subordinate criminal court\u2019s record and correct a finding, sentence, or order that is <strong>illegal, improper, or irregular<\/strong>. It is supervisory. It is not a full rehearing of the evidence in the way a first appeal often is.<\/p>\n<p>The power existed under <strong>Sections 397\u2013401<\/strong> of the <strong>Code of Criminal Procedure, 1973 (CrPC)<\/strong>. It now sits in <strong>Sections 438\u2013442<\/strong> of the <strong>Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS)<\/strong>. The tests are the same. The section numbers changed on <strong>1 July 2024<\/strong>.<\/p>\n<p>Revision is the remedy used when <strong>no appeal lies<\/strong>, or when the defect is a jurisdictional or legal error that should not wait for a full trial or a full appeal. It is also the remedy that is <strong>barred<\/strong> against a purely interlocutory order \u2014 which is why so many revisions fail at the threshold.<\/p>\n<p>At <strong>The Chambers of Tarun Gaur, <a href=\"https:\/\/tarungaur.in\/mediacenter\/why-choose-tarun-gaur-advocate-best-criminal-lawyer-in-delhi\/\" target=\"_blank\" rel=\"noopener\">Advocates at Delhi High Court<\/a><\/strong>, criminal revisions before the Sessions Court and the <strong>Delhi High Court<\/strong> are part of the same practice as appeals, discharge, and quashing. <strong>Advocate Tarun Gaur<\/strong> appears independently in the Delhi High Court after training under <strong>Mohit Mathur, Senior Advocate<\/strong>, former President of the Delhi High Court Bar Association.<\/p>\n<h2>What Revision Examines<\/h2>\n<p><strong>Section 438(1) BNSS<\/strong> (old <strong>Section 397(1) CrPC<\/strong>) lets the High Court or any Sessions Judge call for the record of an inferior criminal court in its local jurisdiction to satisfy itself as to:<\/p>\n<ul>\n<li>the <strong>correctness, legality or propriety<\/strong> of any finding, sentence, or order; and<\/li>\n<li>the <strong>regularity<\/strong> of the proceedings.<\/li>\n<\/ul>\n<p>While the record is called, the court may <strong>suspend<\/strong> execution of the sentence or order and, if the accused is in custody, release him on bond pending examination of the record.<\/p>\n<p>Every Magistrate \u2014 judicial or executive, original or appellate \u2014 is \u201cinferior\u201d to the Sessions Judge for this chapter.<\/p>\n<p>Revision can be moved by a party. Revision is not a spare appeal with a lighter court-fee.<\/p>\n<p>If the order is a purely interlocutory step in a pending trial, revision is the wrong gate. The High Court\u2019s inherent power under <strong>Section 528 BNSS \/ Section 482 CrPC<\/strong> may still be open in a proper case \u2014 Delhi High Court practice often turns on that distinction.<\/p>\n<h2>The Interlocutory-Order Bar<\/h2>\n<p><strong>Section 438(2) BNSS<\/strong> (old <strong>Section 397(2) CrPC<\/strong>) is the provision that decides maintainability:<\/p>\n<p>Revision shall <strong>not<\/strong> be exercised in relation to any <strong>interlocutory order<\/strong> passed in any appeal, inquiry, trial, or other proceeding.<\/p>\n<p>The code does not define \u201cinterlocutory.\u201d The Supreme Court does.<\/p>\n<p><strong>Pure interlocutory orders<\/strong> (no revision):<\/p>\n<p>adjournments, summoning a witness, calling for a report, many routine bail steps in aid of the proceeding, issuance of a mere notice on an application. These do not decide rights. Allowing revision against them would stall every trial.<\/p>\n<p><strong>Final orders<\/strong> (revision may lie, subject to the rest of the chapter):<\/p>\n<p>conviction, acquittal, discharge, dismissal of a complaint, an order that ends the proceeding.<\/p>\n<p><strong>Intermediate orders<\/strong> (revision may lie):<\/p>\n<p>orders that are not the last word in the case, but that <strong>substantially affect rights<\/strong> or a vital aspect of the trial. <em>Amar Nath v. State of Haryana<\/em>, <em>Madhu Limaye v. State of Maharashtra<\/em>, and later cases treat this third category as outside the bar. An order that, if left untouched, would cause irreparable prejudice is not \u201cpurely interlocutory\u201d merely because the trial is still pending.<\/p>\n<p><strong>Working examples<\/strong><\/p>\n<ul>\n<li>Order <strong>framing charge<\/strong> \/ refusing discharge \u2014 generally treated as intermediate; revision is often the first challenge.<\/li>\n<li>Order <strong>taking cognizance and summoning the accused<\/strong> \u2014 as against the <strong>accused<\/strong>, commonly treated as intermediate (it forces him into a criminal case). As against a <strong>complainant<\/strong> who is unhappy that someone was summoned, courts have called it interlocutory and sent the complainant to Section 528 \/ 482.<\/li>\n<li>Order dismissing an application that only manages the diary \u2014 interlocutory.<\/li>\n<li>Order of regular bail \u2014 often treated as interlocutory for revision; cancellation or inherent jurisdiction may be the other path.<\/li>\n<\/ul>\n<p>Getting this classification wrong is the most common reason a revision is dismissed at the admission stage in the <strong>Delhi High Court<\/strong>.<\/p>\n<h2>Sessions or High Court \u2014 Concurrent Jurisdiction<\/h2>\n<p>Section 438 gives <strong>both<\/strong> the Sessions Judge and the High Court the power to call for a Magistrate\u2019s record.<\/p>\n<p><strong>Section 438(3) BNSS<\/strong> (old <strong>Section 397(3) CrPC<\/strong>) then shuts a door: if a person has applied to <strong>one<\/strong> of them, <strong>no further revision by the same person<\/strong> will be entertained by the <strong>other<\/strong>.<\/p>\n<p>There is no second revision. A party who loses a revision before Sessions cannot file another revision in the High Court on the same order. The High Court may still look at the matter under <strong>Section 528 BNSS \/ Section 482 CrPC<\/strong> in a fit case, but that is not a second revision, and it is not automatic.<\/p>\n<p><strong>Propriety:<\/strong> concurrent jurisdiction does not mean every Magistrate order should land first on the High Court board. Courts have said the Sessions Court should ordinarily be approached first, except for rare and special reasons. Filing straight in the High Court is maintainable; it is often not proper.<\/p>\n<p><strong>Section 440 BNSS<\/strong> (old <strong>Section 399 CrPC<\/strong>) sets out the Sessions Judge\u2019s revisional powers. <strong>Section 441<\/strong> lets an Additional Sessions Judge exercise them in cases transferred to him. <strong>Section 442 BNSS<\/strong> (old <strong>Section 401 CrPC<\/strong>) sets out the High Court\u2019s powers: it may use specified powers of an appellate court, including suspension of sentence on the lines of Section 430, but it <strong>cannot turn an acquittal into a conviction<\/strong>. No order to the prejudice of the accused is to be made without hearing him.<\/p>\n<p><strong>Section 439 BNSS<\/strong> (old <strong>Section 398 CrPC<\/strong>) allows a direction for further inquiry in specified situations.<\/p>\n<h2>How Narrow the Merits Review Is<\/h2>\n<p>Revision is for:<\/p>\n<ul>\n<li>want or excess of <strong>jurisdiction<\/strong>;<\/li>\n<li>violation of a <strong>mandatory procedure<\/strong>;<\/li>\n<li>a finding that is <strong>perverse<\/strong> \u2014 no evidence, or a conclusion no reasonable court could reach on that record;<\/li>\n<li>an illegal <strong>sentence<\/strong>;<\/li>\n<li>a <strong>gross miscarriage of justice<\/strong>.<\/li>\n<\/ul>\n<p>It is not for:<\/p>\n<ul>\n<li>re-weighing which witness was more believable, as if the revisional court were the trial court;<\/li>\n<li>filling gaps the party failed to lead at the proper stage;<\/li>\n<li>stalling a trial with a challenge to every listing order.<\/li>\n<\/ul>\n<p>Even where revision against a conviction is maintainable because no appeal was filed or no appeal lies, the court is slower to interfere than in a first appeal.<\/p>\n<p>Limitation applies. Delay can be condoned for sufficient cause, but a stale challenge to a charge order, after the trial has moved on, is argued uphill.<\/p>\n<h2>Suspension of Sentence in a Revision<\/h2>\n<p>Section 438(1) itself allows the revisional court, when calling for the record, to suspend the sentence or order and release the accused on bond. Section 442 then points to appellate<\/p>\n<p>powers that include the suspension machinery aligned with <strong>Section 430 BNSS \/ Section 389 CrPC<\/strong>.<\/p>\n<p>That is still not automatic. A convict who has a revision (and not an appeal) must ask for suspension with reasons \u2014 sentence length, time undergone, the legal defect pointed out \u2014 just as in an appeal.<\/p>\n<h2>Typical Revisions in Delhi Practice<\/h2>\n<ul>\n<li>Challenge to <strong>framing of charge<\/strong> or refusal of <strong>discharge<\/strong> (Sessions \/ warrant cases; and now, where used, summons-case discharge under Section 274 BNSS).<\/li>\n<li>Challenge to <strong>dismissal of a complaint<\/strong> or refusal to take cognizance.<\/li>\n<li>Challenge to an order that is intermediate and prejudicial, not a diary order.<\/li>\n<li>Challenge to the <strong>legality of sentence<\/strong> where the appellate chapter does not apply.<\/li>\n<li>Complainant\u2019s or accused\u2019s challenge to an order that effectively ends or gravely skews the proceeding.<\/li>\n<\/ul>\n<p>A summons-case accused under the <strong>CrPC<\/strong> still cannot obtain Magistrate-level discharge after process. Revision or a High Court petition is often the only pre-trial court challenge. That is the point of Section 438(2) \/ 397(2).<\/li>\n<li><strong>Sessions dismissed my revision. Can I file another in the High Court?<br \/>\n<\/strong>Not a second revision by the same person. Inherent jurisdiction is a different, narrower ask.<\/li>\n<li><strong>Should I go to Sessions or straight to the Delhi High Court?<br \/>\n<\/strong>Both have power. Propriety usually means Sessions first against a Magistrate\u2019s order, unless there is a special reason.<\/li>\n<li><strong>The trial court acquitted the accused.
