State (NCT of Delhi)<\/em> upheld the validity of a magistrate\u2019s direction to register an FIR under <strong data-start=\"2221\" data-end=\"2244\">Section 156(3) CrPC<\/strong>, despite the complainant not approaching the police hierarchy as per <strong data-start=\"2314\" data-end=\"2332\">Section 154(3)<\/strong>.<\/p>\n<h3 data-section-id=\"11oehh3\" data-start=\"2335\" data-end=\"2367\">\u2696\ufe0f The Court\u2019s Core Finding:<\/h3>\n<p data-start=\"2369\" data-end=\"2618\">The Bench of Justices Pankaj Mithal and SVN Bhatti held that while ordinarily a complainant <strong data-start=\"2461\" data-end=\"2510\">should first seek remedy under Section 154(3)<\/strong> (i.e., approach higher police officials), the <strong data-start=\"2557\" data-end=\"2599\">magistrate\u2019s power to act under 156(3)<\/strong> remains intact if:<\/p>\n<ul data-start=\"2620\" data-end=\"2750\">\n<li data-start=\"2620\" data-end=\"2677\">\n<p data-start=\"2622\" data-end=\"2677\">The complaint <strong data-start=\"2636\" data-end=\"2670\">discloses a cognizable offence<\/strong>, and<\/p>\n<\/li>\n<li data-start=\"2678\" data-end=\"2750\">\n<p data-start=\"2680\" data-end=\"2750\">The <strong data-start=\"2684\" data-end=\"2719\">magistrate has applied his mind<\/strong> before ordering investigation.<\/p>\n<\/li>\n<\/ul>\n<h3 data-section-id=\"1g5ttbw\" data-start=\"2752\" data-end=\"2810\">\ud83d\udd0d Procedural Irregularity \u2260 Jurisdictional Illegality<\/h3>\n<p data-start=\"2812\" data-end=\"2827\">The Court held:<\/p>\n<blockquote data-start=\"2828\" data-end=\"2957\">\n<p data-start=\"2830\" data-end=\"2957\">\u201cThe Magistrate\u2019s order may be irregular but is not without jurisdiction\u2026 The procedural lapse does not render the order void.\u201d<\/p>\n<\/blockquote>\n<p data-start=\"2959\" data-end=\"3153\">It reiterated that such procedural deviations <strong data-start=\"3005\" data-end=\"3042\">cause no prejudice to the accused<\/strong>, and should not curtail an individual\u2019s right to initiate criminal proceedings when serious allegations exist.<\/p>\n<h3 data-section-id=\"1x1qzzt\" data-start=\"3155\" data-end=\"3196\">\ud83d\udcac Advocate Tarun Gaur\u2019s Perspective:<\/h3>\n<p data-start=\"3198\" data-end=\"3551\">This judgment is a <strong data-start=\"3217\" data-end=\"3280\">powerful reaffirmation of access to justice in criminal law<\/strong>. The object of Section 156(3) is to allow the criminal justice machinery to be activated in cases where police inaction or delay may defeat the purpose of prosecution.
