Whether it is <strong data-start=\"486\" data-end=\"589\">bail provisions, attachment of assets, prolonged investigations, or the reversal of burden of proof<\/strong>, the PMLA machinery has left the ordinary citizen gasping for procedural fairness.<\/p>\n<p data-start=\"674\" data-end=\"979\">At almost every step, <strong data-start=\"696\" data-end=\"778\">both legislative policy and judicial interpretations have made the law harsher<\/strong>, often at the cost of fundamental rights. For years, critics (myself included) have pointed out how PMLA has become <strong data-start=\"895\" data-end=\"978\">a tool of investigative oppression rather than just a financial crime regulator<\/strong>.<\/p>\n<p data-start=\"981\" data-end=\"1293\">But in this dark maze, the <strong data-start=\"1008\" data-end=\"1083\">Supreme Court&#8217;s judgment in Pankaj Bansal v. Directorate of Enforcement<\/strong> has emerged as <strong data-start=\"1099\" data-end=\"1141\">a rare, favorable step for the accused<\/strong>. It is perhaps the <strong data-start=\"1161\" data-end=\"1244\">first significant judicial intervention in recent times to restore some balance<\/strong> between enforcement powers and personal liberty.<\/p>\n<hr data-start=\"1295\" data-end=\"1298\" \/>\n<h3 data-start=\"1300\" data-end=\"1348\"><strong data-start=\"1304\" data-end=\"1348\">What Did the Pankaj Bansal Judgment Say?<\/strong><\/h3>\n<p data-start=\"1350\" data-end=\"1547\">In <strong data-start=\"1353\" data-end=\"1383\">Pankaj Bansal v. ED (2023)<\/strong>, the **Supreme Court held that Enforcement Directorate officials must furnish the grounds of arrest to the accused <strong data-start=\"1499\" data-end=\"1513\">in writing<\/strong> under <strong data-start=\"1520\" data-end=\"1546\">Section 19 of the PMLA<\/strong>.<\/p>\n<p data-start=\"1549\" data-end=\"1560\">This means:<\/p>\n<ul data-start=\"1561\" data-end=\"1815\">\n<li data-start=\"1561\" data-end=\"1647\">\n<p data-start=\"1563\" data-end=\"1647\">It is <strong data-start=\"1569\" data-end=\"1646\">not enough for the ED to merely orally tell you why you\u2019re being arrested<\/strong>.<\/p>\n<\/li>\n<li data-start=\"1648\" data-end=\"1737\">\n<p data-start=\"1650\" data-end=\"1737\">A <strong data-start=\"1652\" data-end=\"1736\">written disclosure of reasons must be given to the accused at the time of arrest<\/strong>.<\/p>\n<\/li>\n<li data-start=\"1738\" data-end=\"1815\">\n<p data-start=\"1740\" data-end=\"1815\">Failure to do so will make the arrest <strong data-start=\"1778\" data-end=\"1814\">illegal and liable to be quashed<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1817\" data-end=\"2015\">The Court explicitly connected this requirement to the <strong data-start=\"1872\" data-end=\"1933\">constitutional right to personal liberty under Article 21<\/strong>, reaffirming that <strong data-start=\"1952\" data-end=\"2014\">due process cannot be sacrificed even in economic offences<\/strong>.<\/p>\n<hr data-start=\"2017\" data-end=\"2020\" \/>\n<h3 data-start=\"2022\" data-end=\"2064\"><strong data-start=\"2026\" data-end=\"2064\">Why Is This Judgment So Important?<\/strong><\/h3>\n<p data-start=\"2066\" data-end=\"2139\">Let\u2019s be honest:<br data-start=\"2082\" data-end=\"2085\" \/><strong data-start=\"2085\" data-end=\"2138\">PMLA has been systematically weaponized over time<\/strong>.<\/p>\n<h4 data-start=\"2141\" data-end=\"2199\"><strong data-start=\"2146\" data-end=\"2199\">Some critical aspects of this &#8220;draconian&#8221; design:<\/strong><\/h4>\n<ul data-start=\"2200\" data-end=\"2676\">\n<li data-start=\"2200\" data-end=\"2366\">\n<p data-start=\"2202\" data-end=\"2366\"><strong data-start=\"2202\" data-end=\"2238\">Stringent Bail (Section 45 PMLA)<\/strong>: Near impossible to secure bail due to the twin conditions of &#8220;no prima facie case&#8221; and &#8220;not likely to commit another offence.&#8221;<\/p>\n<\/li>\n<li data-start=\"2367\" data-end=\"2464\">\n<p data-start=\"2369\" data-end=\"2464\"><strong data-start=\"2369\" data-end=\"2395\">Attachment of Property<\/strong>: Before trial, before evidence, even before filing of a chargesheet.<\/p>\n<\/li>\n<li data-start=\"2465\" data-end=\"2582\">\n<p data-start=\"2467\" data-end=\"2582\"><strong data-start=\"2467\" data-end=\"2491\">Presumption of Guilt<\/strong>: The accused has to prove innocence\u2014completely against traditional criminal jurisprudence.<\/p>\n<\/li>\n<li data-start=\"2583\" data-end=\"2676\">\n<p data-start=\"2585\" data-end=\"2676\"><strong data-start=\"2585\" data-end=\"2609\">Unfettered ED Powers<\/strong>: With little judicial oversight in the arrest and seizure process.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2678\" data-end=\"2901\">In such an environment, the <strong data-start=\"2706\" data-end=\"2782\">Pankaj Bansal judgment acts like the first breath of procedural fairness<\/strong> in years. It acknowledges that <strong data-start=\"2814\" data-end=\"2901\">\u201cenforcement of economic offences cannot come at the cost of fundamental freedoms.\u201d<\/strong><\/p>\n<hr data-start=\"2903\" data-end=\"2906\" \/>\n<h3 data-start=\"2908\" data-end=\"2959\"><strong data-start=\"2912\" data-end=\"2959\">Legal Reasoning: A Step Towards Rule of Law<\/strong><\/h3>\n<p data-start=\"2961\" data-end=\"3119\">The judgment draws strength from the <strong data-start=\"2998\" data-end=\"3038\">constitutional mandate of Article 21<\/strong>\u2014the <strong data-start=\"3043\" data-end=\"3081\">Right to Life and Personal Liberty<\/strong>. The <strong data-start=\"3087\" data-end=\"3113\">Supreme Court reasoned<\/strong> that:<\/p>\n<blockquote data-start=\"3121\" data-end=\"3241\">\n<p data-start=\"3123\" data-end=\"3241\"><strong data-start=\"3123\" data-end=\"3241\">\u201cAn arrested person must know, in writing, the precise reasons for his arrest to enable effective legal recourse.\u201d<\/strong><\/p>\n<\/blockquote>\n<p data-start=\"3243\" data-end=\"3439\">This is consistent with the global principle of <strong data-start=\"3291\" data-end=\"3338\">\u201cAudi Alteram Partem\u201d (hear the other side)<\/strong>. How can an accused prepare for defense or seek bail if he doesn&#8217;t even know why he\u2019s been arrested?<\/p>\n<p data-start=\"3441\" data-end=\"3479\">Additionally, this ruling aligns with:<\/p>\n<ul data-start=\"3480\" data-end=\"3688\">\n<li data-start=\"3480\" data-end=\"3555\">\n<p data-start=\"3482\" data-end=\"3555\"><strong data-start=\"3482\" data-end=\"3516\">Article 22 of the Constitution<\/strong> (protection against arbitrary arrest),<\/p>\n<\/li>\n<li data-start=\"3556\" data-end=\"3615\">\n<p data-start=\"3558\" data-end=\"3615\"><strong data-start=\"3558\" data-end=\"3580\">DK Basu Guidelines<\/strong> (arrest procedure safeguards), and<\/p>\n<\/li>\n<li data-start=\"3616\" data-end=\"3688\">\n<p data-start=\"3618\" data-end=\"3688\"><strong data-start=\"3618\" data-end=\"3654\">International Human Rights norms<\/strong> under <strong data-start=\"3661\" data-end=\"3687\">Article 9 of the ICCPR<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"3690\" data-end=\"3693\" \/>\n<h3 data-start=\"3695\" data-end=\"3749\"><strong data-start=\"3699\" data-end=\"3749\">But Here\u2019s the Catch: The Retrospectivity Mess<\/strong><\/h3>\n<p data-start=\"3751\" data-end=\"3891\">Despite this judgment, the courts have created confusion about whether the <strong data-start=\"3826\" data-end=\"3890\">Pankaj Bansal ruling applies to cases before October 3, 2023<\/strong>.<\/p>\n<p data-start=\"3893\" data-end=\"4135\">Some High Courts (like Punjab &amp; Haryana) have said <strong data-start=\"3944\" data-end=\"3974\">\u201cNo retrospective benefit\u201d<\/strong>.<br data-start=\"3975\" data-end=\"3978\" \/>But the <strong data-start=\"3986\" data-end=\"4054\">Supreme Court itself has raised serious doubts about this stance<\/strong>, especially since <strong data-start=\"4073\" data-end=\"4134\">Pankaj Bansal\u2019s own arrest was quashed on similar grounds<\/strong>.<\/p>\n<p data-start=\"4137\" data-end=\"4193\"><strong data-start=\"4137\" data-end=\"4193\">This legal contradiction needs urgent clarification.<\/strong><\/p>\n<hr data-start=\"4195\" data-end=\"4198\" \/>\n<h3 data-start=\"4200\" data-end=\"4256\"><strong data-start=\"4204\" data-end=\"4256\">My Take: One Small Relief in a Sea of Oppression<\/strong><\/h3>\n<p data-start=\"4258\" data-end=\"4359\">As someone who routinely deals with white-collar criminal litigation, I can say this with conviction:<\/p>\n<blockquote data-start=\"4361\" data-end=\"4621\">\n<p data-start=\"4363\" data-end=\"4621\"><strong data-start=\"4363\" data-end=\"4468\">The Pankaj Bansal ruling is perhaps the only recent judicial step that favors the accused under PMLA.<\/strong><br data-start=\"4468\" data-end=\"4471\" \/>Otherwise, <strong data-start=\"4484\" data-end=\"4621\">both the legislature and judiciary have left no stone unturned to ensure that the law abridges one\u2019s liberty at every possible stage.<\/strong><\/p>\n<\/blockquote>\n<p data-start=\"4623\" data-end=\"4746\">From <strong data-start=\"4628\" data-end=\"4694\">ED summons to bail denials, asset seizures to extended custody<\/strong>, the system is designed to punish you before trial.<\/p>\n<p data-start=\"4748\" data-end=\"4863\">This judgment, however limited in scope, <strong data-start=\"4789\" data-end=\"4862\">is a small yet significant reaffirmation of constitutional principles<\/strong>.<\/p>\n<hr data-start=\"4865\" data-end=\"4868\" \/>\n<h3 data-start=\"4870\" data-end=\"4924\"><strong data-start=\"4874\" data-end=\"4924\">Final Thoughts: Liberty Must Not Be a Casualty<\/strong><\/h3>\n<p data-start=\"4926\" data-end=\"4976\">Let us not forget the first principles of justice:<\/p>\n<ul data-start=\"4978\" data-end=\"5145\">\n<li data-start=\"4978\" data-end=\"5066\">\n<p data-start=\"4980\" data-end=\"5066\"><strong data-start=\"4980\" data-end=\"5066\">The State\u2019s might must not bulldoze individual rights without procedural fairness.<\/strong><\/p>\n<\/li>\n<li data-start=\"5067\" data-end=\"5145\">\n<p data-start=\"5069\" data-end=\"5145\"><strong data-start=\"5069\" data-end=\"5145\">Economic crime control cannot justify turning India into a police state.<\/strong><\/p>\n<\/li>\n<\/ul>\n<p data-start=\"5147\" data-end=\"5347\">The <strong data-start=\"5151\" data-end=\"5246\">Pankaj Bansal judgment rekindles the hope that the judiciary still recognizes this balance.<\/strong><br data-start=\"5246\" data-end=\"5249\" \/>It may be <strong data-start=\"5259\" data-end=\"5286\">just one favorable step<\/strong>, but in today\u2019s PMLA regime, <strong data-start=\"5316\" data-end=\"5347\">even one such step matters.<\/strong><\/p>\n<hr data-start=\"5349\" data-end=\"5352\" \/>\n<h3 data-start=\"5354\" data-end=\"5378\"><strong data-start=\"5358\" data-end=\"5378\">About the
