{"id":1036,"date":"2025-06-27T10:09:35","date_gmt":"2025-06-27T10:09:35","guid":{"rendered":"https:\/\/tarungaur.in\/mediacenter\/?p=1036"},"modified":"2026-02-07T17:37:23","modified_gmt":"2026-02-07T12:07:23","slug":"supreme-court-mahnoor-fatima-possession-vs-title","status":"publish","type":"post","link":"https:\/\/tarungaur.in\/mediacenter\/supreme-court-mahnoor-fatima-possession-vs-title\/","title":{"rendered":"Where the Supreme Court Might Have Erred in Mahnoor Fatima Imran Case"},"content":{"rendered":"<p><em data-start=\"661\" data-end=\"717\">By Advocate Tarun Gaur, Practicing in Delhi High Court<\/em><\/p>\n<p id=\"ember852\" class=\"ember-view reader-text-block__paragraph\">With utmost respect to the Hon\u2019ble Supreme Court of India, the recent judgment in <em>Mahnoor Fatima Imran &amp; Ors. v. M\/s Visweswara Infrastructure Pvt. Ltd &amp; Ors.<\/em> (2025 INSC 646) raises pertinent concerns around the scope of a possession-based proceedings, the retrospective application of <em>Suraj Lamp<\/em> (2012) 1 SCC 656, and the fundamental distinction between <em>title<\/em> and <em>possession<\/em> in civil jurisprudence.<\/p>\n<h3 id=\"ember853\" class=\"ember-view reader-text-block__heading-3\">\u26a0\ufe0f The Core Misapplication: Retrospective Reading of Suraj Lamp<\/h3>\n<p id=\"ember854\" class=\"ember-view reader-text-block__paragraph\">At the heart of the dispute was an unregistered agreement to sell dated 19.03.1982, on the strength of which the petitioners derived subsequent sale deeds. The Hon\u2019ble Supreme Court, while analysing the defective title, relied heavily on the <em>Suraj Lamp<\/em> ruling to discredit the claim. However, it is respectfully submitted that <em>Suraj Lamp<\/em> was never intended to apply <strong>retrospectively<\/strong>.<\/p>\n<p id=\"ember855\" class=\"ember-view reader-text-block__paragraph\">The Supreme Court itself, in <em>Suraj Lamp<\/em>, had clarified that its ruling would apply <strong>prospectively<\/strong>, i.e., to prevent future transfers through GPA\/SA\/WILL mechanisms and not to unsettle past transactions. Applying the doctrine retrospectively to a 1982 transaction is, in my view, legally inappropriate and causes avoidable hardship to parties who relied on the then-prevailing norms.<\/p>\n<h3 id=\"ember856\" class=\"ember-view reader-text-block__heading-3\">\ud83c\udfda\ufe0f Title Was Defective \u2014 But That Wasn\u2019t the Real Issue<\/h3>\n<p id=\"ember857\" class=\"ember-view reader-text-block__paragraph\">I agree with the Single Judge and the Supreme Court on two key points:<\/p>\n<ol>\n<li>The <strong>No Objection Certificate<\/strong> (NOC) under the Urban Land Ceiling Act was cancelled and never challenged \u2014 a clear red flag.<\/li>\n<li>The <strong>suit for specific performance<\/strong> filed by Bhavana Society was dismissed for default and was never restored \u2014 which severely weakens the foundation of the title.<\/li>\n<\/ol>\n<p id=\"ember859\" class=\"ember-view reader-text-block__paragraph\">However, that does not end the matter.<\/p>\n<h3 id=\"ember860\" class=\"ember-view reader-text-block__heading-3\">\ud83e\uddf1 Possession \u2260 Title \u2014 The Central Legal Misstep<\/h3>\n<p id=\"ember861\" class=\"ember-view reader-text-block__paragraph\">The proceedings before the Telangana High Court was not for a declaration of ownership. It was a plea to prevent dispossession \u2014 a <strong>simple prayer for preservation of possession<\/strong>.<\/p>\n<p id=\"ember862\" class=\"ember-view reader-text-block__paragraph\">In such cases, the well-settled legal position is that <strong>lawful possession alone is sufficient<\/strong> to seek protection from illegal dispossession \u2014 regardless of title. The Supreme Court in <em>Krishna Ram Mahale v. Shobha Venkat Rao<\/em> and numerous other judgments has upheld that even a person in settled possession \u2014 even a trespasser \u2014 cannot be evicted except by due process of law.<\/p>\n<p id=\"ember863\" class=\"ember-view reader-text-block__paragraph\">With due respect, the Hon\u2019ble Supreme Court appears to have elevated the issue of <em>faulty title<\/em> beyond its relevance in a proceeding based purely on <strong>possession<\/strong>.<\/p>\n<h3 id=\"ember864\" class=\"ember-view reader-text-block__heading-3\">\ud83e\uddfe A Binding Analogy: Chandrashekhar v. Rahul Shikshan Prasarak Mandal<\/h3>\n<p id=\"ember865\" class=\"ember-view reader-text-block__paragraph\">The Bombay High Court\u2019s decision in <em>Chandrashekhar Shankar Rao Kulkarni v. Rahul Shikshan Prasarak Mandal<\/em> (2007 (2) Mh.L.J. 296) is instructive:<\/p>\n<blockquote id=\"ember866\" class=\"ember-view reader-text-block__blockquote\"><p><em>&#8220;A decree seeking perpetual injunction can be granted if the person seeking injunction proves his possession over the suit property on the date of filing of suit referable to some lawful right. It is not necessary for the court to decide the title of the plaintiff.&#8221;<\/em><\/p><\/blockquote>\n<p id=\"ember867\" class=\"ember-view reader-text-block__paragraph\">This ratio strikes the right balance \u2014 that possession linked to some lawful origin (even if defective) is sufficient to seek judicial protection. The Hon\u2019ble Supreme Court was not bound by this High Court judgment, but its reasoning, in my opinion, deserved consideration and perhaps adoption.<\/p>\n<h3 id=\"ember868\" class=\"ember-view reader-text-block__heading-3\">\ud83e\udded The Correct Way Forward?<\/h3>\n<p id=\"ember869\" class=\"ember-view reader-text-block__paragraph\">The correct approach, in my view, would have been:<\/p>\n<ul>\n<li>Recognise the <strong>difference<\/strong> between establishing ownership and preserving possession.<\/li>\n<li>Leave the question of <strong>title and fraud<\/strong> to be adjudicated in appropriate civil proceedings.<\/li>\n<li>Limit the court\u2019s intervention to deciding whether the petitioners were in <strong>settled possession<\/strong>, and if yes, whether they were being evicted <em>without recourse to law<\/em>.<\/li>\n<\/ul>\n<p id=\"ember871\" class=\"ember-view reader-text-block__paragraph\">The preservation of possession need not \u2014 and should not \u2014 hinge on proving perfect title. This is especially true when the prayer is against high-handed dispossession by the State.<\/p>\n<hr class=\"reader-divider-block__horizontal-rule\" \/>\n<h3 id=\"ember872\" class=\"ember-view reader-text-block__heading-3\">\ud83d\udccc Conclusion<\/h3>\n<p id=\"ember873\" class=\"ember-view reader-text-block__paragraph\">While the judgment is well-reasoned on paper and grounded in suspicion of fraud, it blurs the crucial legal line between <em>title-based claims<\/em> and <em>possession-based protections<\/em>. With respect, this decision may inadvertently dilute protections available to bona fide possessors and embolden State actors to dispossess without due process, so long as the title is murky.<\/p>\n<p id=\"ember874\" class=\"ember-view reader-text-block__paragraph\">Let us hope future benches take the opportunity to revisit and refine this area of law, reinforcing the distinction between possession
